1. Introduction

At ZENIQ Consultancy (hereinafter referred to as ‘’ZENIQ”, “we”, ‘’our’’, or ‘’us’’), we are committed to protecting and respecting your privacy. This Privacy Statement (hereinafter referred to as “Privacy Statement’’) explains how and why we process and safeguard your personal data, who has access to personal data and how you can exercise your rights in relation to your personal data.

2. Data Controller

The data controller for the processing of personal data is: ZENIQ Consultancy, registered with the Dutch Chamber of Commerce under number 97121673.

3. What personal data do we process?

We may collect your name, surname, e-mail address, phone number, invoice and payment details including residential and mailing address, company name and job titles, e-mails, messages or inquiries sent to us.

4. Why do we process your personal data?

We may collect, transfer, store, disclose or otherwise process your personal data for providing services, processing payments and administrative obligations, scheduling and conducting appointments and for ensuring that ZENIQ remains compliance with legal obligations.

We shall in no way process your personal data for the purposes that are incompatible with the purposes listed above, unless it is required or authorized by applicable law.

5. On what "legal grounds" do we process your information?

We may process your personal data only when there is a clear reason to do so. Under the General Data Protection Regulation (hereinafter referred to as “GDPR”), we must always explain which legal basis applies. We process your personal data for the purposes set out in this Privacy Statement based on one or more of the following legal grounds:

• Contractual obligations

• Legal obligation

• Consent, where applicable.

• Legitimate interest, such as business operations and security, if this does not override your interests, rights or freedoms.

Where processing is based on consent, you can withdraw your consent at any time.   

6. How long do we retain your personal data?

ZENIQ shall in no way retain your personal data longer than necessary for the purposes for which it was collected, unless a longer retention period is legally required. Your personal data will be securely deleted or anonymized after the retention period expires.

7. How we protect and secure your personal data?

We are fully committed to protecting and secure your personal data. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk and protect personal data against accidental or unlawful destruction, loss, alteration, access or unauthorized disclosure.

8. How do we collect and obtain your personal data?

In the context of services provided, we collect personal data directly from you and, where appropriate, from other lawful sources. These may include your personal data provided during the contact form (e.g., your name, e-mail address, contact details) and throughout the services (e.g., bank account information). Your decision to provide any personal data to ZENIQ is voluntary unless the information is strictly required by the applicable law.

9. Who has access to your data?

ZENIQ may share your personal data with third parties only insofar as this is strictly necessary to provide services, meet contractual obligations, and comply with legal obligations and requirements, where relevant.  This may include IT and hosting service providers and payment service providers.

If your personal data is transferred to third parties (including third parties outside the European Economic Area (EEA)), we will ensure appropriate safeguards are in place, such as:

• Adequacy decisions by the European Commission.

• Standard Contractual Clauses approved by regulators.

• Additional security and compliance measures as required.

We shall in no way sell your personal data to third parties.

10. What rights do you have about your personal data?

You have right to access, correct, update or request deletion of your personal data. In certain circumstances, you may also have right to restrict or object to the processing of your data, as well as the right to data portability.

1. Right of Access – to obtain a copy of your personal data.

2. Right to Rectification – to correct inaccurate or incomplete data.

3. Right to Erasure (‘’to be forgotten) – to request deletion of your data where no longer necessary.

4. Right to Restriction – to request limitation of data processing.

5. Right to Data Portability – to receive your data in a structured, commonly used format.

6. Right to Object – to object to processing based on legitimate interests.

7. Right to Withdraw Consent – where processing is based on consent, you may withdraw it at any time.

8. Right to Lodge a Complaint – with your local data protection authority.

11. How can you exercise your rights about your personal data?

If you wish to exercise any of your rights stated above, you can contact us by sending an email to elif@zeniqconsultancy.com. Where we rely on your consent to process your personal data, you have the right to withdraw your consent at any time by sending an e-mail to elif@zeniqconsultancy.com. However, this withdrawal will not affect ZENIQ’s right to process your personal data obtained prior to the withdrawal of your consent, or its right to continue parts of processing based on other legal bases than your consent.

We will respond to your request in accordance with applicable data protection laws. If you believe that your rights have been violated, or you are not satisfied with the response on your request, you have right to file a complaint with the supervisory authority, either in the country where you reside or work, or the country you deem that data protection law has been infringed. The supervisory authority in the Netherlands is the Dutch Data Protection Authority, Autoriteit Persoonsgegevens.
